You must read and agree to the terms set forth below in order to work as an independent contractor.

Licensing Agreement

Relationship of Parties: You are registering with JamPro Management, LLC DBA Evaluation Shopping Service (‘Company’) as an independent contractor (‘Contractor’). You acknowledge that you are not an agent or employee of the Company for any purpose and are not entitled to any of the benefits the Company may provide for its employees.

Duties and Services: The Contractor shall have the non-exclusive right to perform an assignment given by the Company related to the retail shopping industry, or such other services of the Company.

Company acceptance of this application does not guarantee work for the Contractor.

Allocated assignments must be completed by the Contractor as outlined in the assignments instructions. Failure to complete an assignment as instructed may result in reduction or forfeit of payment and/or Compensation.

Contractor must make aware if he/she has worked at the location we are evaluating.

Duration of Agreement: This agreement shall be deemed effective as of the date or its acceptance by the Contractor. It may be cancelled at any time by either party.

Ownership: The Contractor agrees that all work or services performed for the Company by the Contractor shall be considered work for hire and that the Company shall retain all rights, ownership, possession and copyrights relating in any way to the work of the Company.

Compensation and Payment: The Contractor shall be compensated with payment, as specified in writing (via email), for each successfully completed assignment. An assignment is considered successfully completed once it has been accepted by the Company and all outstanding items related to the Contractors work have been resolved. Failure to complete an assignment as instructed may result in reduction or forfeit of payment and/or Compensation.

The Company shall pay the specified fee, but shall have no obligation for the payment of withholding of social security, FICA taxes, state and local taxes, insurance and worker’s compensation, for which the Contractor shall have sole responsibility.

Indemnification: The Contractor shall indemnify the Company against all liability or loss and against all claims or actions based upon or arising out of or elated to the acts or omissions of the Contractor or based upon any violation of any statute, ordinance or regulation.
